Compliance Statement
ShroomCo operates under Colorado Proposition 122 (the Natural Medicine Health Act, NMHA), passed by Colorado voters in November 2022. We are committed to full transparency about how our business operates within this legal framework.
Colorado Proposition 122
Proposition 122 decriminalised the personal possession, use, and gifting of psilocybin mushrooms for adults 21 and older in Colorado. It permits adults to share natural medicine with other adults for personal use, provided no sale occurs.
The Act also established a regulated framework for psilocybin service centres (licensed healing centres offering supervised sessions), which is administered by the Colorado Natural Medicine Advisory Board. ShroomCo operates under the personal use and gifting provisions of Proposition 122, not as a licensed service centre.
How Our Model Works
Consultation Fee
Customers pay a fee for a wellness consultation service — an assessment that generates a personalised safety and dosing report. This fee is for the consultation only.
Complimentary Gift
Following the consultation, a gift of psilocybin mushrooms is provided to qualified adults as a complimentary wellness accompaniment. No separate charge is made for the product itself.
Age Verification
All recipients are required to verify they are 21 or older through our online age gate and at the point of delivery via government-issued photo ID. No product is transferred without verified age confirmation.
Intra-Colorado Only
All operations, consultations, and deliveries are conducted exclusively within the state of Colorado. We do not ship, deliver, or operate across state lines. Interstate transport of psilocybin remains a federal offence and we strictly prohibit it.
Personal Use Quantities
All gifted quantities are within the personal use thresholds defined under Proposition 122. We do not gift quantities that would exceed personal use amounts as defined by Colorado law.
What We Are Not
- We are not a licensed psilocybin service centre under the NMHA regulatory framework
- We do not provide supervised healing sessions or facilitated psilocybin experiences
- We do not provide medical advice, diagnosis, or treatment
- We do not operate outside Colorado
- We do not sell psilocybin products
Legal Landscape Notice
The legal status of psilocybin in Colorado and federally is evolving. While Proposition 122 provides a state-level framework for adult personal use and gifting, psilocybin remains a Schedule I controlled substance under federal law. Colorado's Proposition 122 does not provide any immunity from federal prosecution.
